ONE MAN’S TROUBLE IS ANOTHER MAN’S TREASURE

York’s Politicus Annus Horribilus appears to be continuing unabated as 2015 happily chugs along.

We all know a major reason is an ineffectual and recalcitrant Minister for Local government and his merry band of misfits still denying York’s citizens their democratic right to have elected representatives. (Unfortunately this untenable situation may not cease in July 2015 when we were told it will.)

Just as importantly, many feel that York has not had a Chief Executive Officer or a council to meet what should be appropriate local government standards, or local community needs, this century. That is fifteen-years of enormous backward steps for one of the Australian mainland’s oldest inland towns-still in existence. Once famous for its major ‘Events’, it is now a non-event.


Enough has been said about Razor Ray Hooper. Since then we have had a new, startlingly ineffective local government administrative dilettante in Michael Keeble.

Not only was he here for six months too long, he had a disgusting “potty-mouth” and the remarkable ability to vacillate. That is twist and turn on a five cent piece in any direction he thought the wind was blowing. (This- being a gentle breeze wafting just for his benefit and best interest.)

Then a strange thing happened, Mr Keeble decided to denigrate the ability of his current administrative staff by saying, to his knowledge, not one of them had a tertiary qualification (of any description) to meet their job descriptions. 

He then selected the Deputy CEO, Tyhscha Cochrane, for a special rant claiming she was not good at her job, had made no reasonable attempt, in three years, to improve her knowledge of local government regulations through appropriate training, and was in charge of the Shire’s official communications library which was antiquated, inefficient and poorly structured. 
And he intended to shift her sideways to another position.


In an inordinately short time after this effort, Michael left the building, and York, hopefully never to be seen or heard from again.

Now his replacement, a Mr. Graeme Simpson from somewhere or other, has claimed his Deputy CEO, one and the same person, is an exemplary employee. And, by inference, any making of little boo-boos through repetitive data entry from what his predecessor stated was an inefficient database is not an uncomment error.

Unfortunately one person’s not uncommon error through repetitive data entry within a Local Government Council database can be another person’s tampering with, and possible falsification of, official Council documents.

Such a massive variation in the assessment of an employee by a different direct superior, in just a few months, beggars belief and once again puts the efficiency, effectiveness and credibility of Local Government Chief Executive Officers under the microscope. 

There is also the effectiveness of the WA Local Government Association (WALGA) in ensuring Local Government probity- and quality. 


The current Chairman of WALGA, Joondalup Mayor Troy Pickard, is allegedly a very close associate of the DLGC’s probity Uber-Spinmiester, Brad Jolly. In fact, some feel they are each other’s doppelganger.

Now here is an interesting bit. Press reports in 2014 said that Wayne Troy Pickard, as Mayor of Joondalup, was accused of a serious breach of the financial interest provisions of the Local government Act 1995. Reports suggested that Prima Facie evidence existed that Mayor Pickard had failed to comply with requirements under section 5.65 of said Act regarding proximity interest between Pickard and a third party.  

At her discretion, determined under section 5.116 of the ACT, the DLGC’s Director General, you guessed it, Jennifer Matthews, decided not to refer the Prima Facie evidence to the State Administrative Tribunal. That good news information for Mayor Pickard was forwarded on by the DLGC’s Executive Director, Sector Regulation and Support. You guessed right again, Brad Jolly.  Enough said!

Nowadays, for a Chief Executive Officer of a Rural Shire to perform to meet required demands, he or she should have the Wisdom of Solomon, the financial acumen of Nelson Rockefeller and the ‘visioning’ of Nostradamus. (A shire Council is a competitive business, in direct competition with other Shire Council’s to attract new ratepayers, new commercial investors and additional tourist numbers to name but a few areas of required generative growth.)

If the Shire of York’s Council or Chief Executive Officers’ have come even close to ticking any of these boxes over the past 15-years- you can line me up in front of a firing squad. What they have done is tried to attract retirees to a potentially collapsible retirement village, attempted to sell contaminated blocks of land to unsuspecting investors, sent the tourist industry to the wall and built a recreation and convention centre which may never be debt free.

A tiny select group of yokels did feel that a major Perth rubbish dump near the town was an  exciting, new, external commercial investment and the possibility of a bauxite mine near the York Racecourse was a once-in-a-lifetime business opportunity.

Maybe this was because there was the potential for a lucrative contract to assist in maintaining the fifty-or-so SITA trucks ploughing up and down the Great Southern Highway each day, or the chance to be a local board member of a Chinese-owned bauxite mining company. Who knows?

The politicized bureaucratic Gods from Perth have told the people of York to forget the issues of their councils past, smell the roses, and move forward to the tune of the Pied Pie-Baker of Byford, Tony Simpson, and his DLGC bureaucratic bungling band.

What I say to them is you cannot guarantee a positive future without ensuring that all the dirty linen of the past has been aired, cleansed and will not be soiled again. I suggest that neither Simpson- nor his DLGC can insure us against that happening.

I now make the following, personal request.



This is- upon their return to office, Councillors Matthew Reid, Denese Smythe, Pat Hooper and David Wallace immediately seek to employ a Chief Executive Officer outside the square, a person who has not been contaminated by being employed as a public servant, particularly under the current WA local government regime. This has happened in the past. (Neither WALGA or the DLGC should have any say in this matter.)

The person chosen should, preferably, be less than forty years of age, have a University Degree in Business Management and be offered a three-year contract only, where clearly defined Key Performance Indicators must be met in specified periods.

Any senior Shire of York staff member, employed prior to April 15, 2014, must immediately undergo a performance revue to ensure their past performance has met the fair and reasonable standards now required by the current Council and ensure that their qualifications and definable expertise meet their current, and past, job descriptions.

There should be no employment positions made available by Council that do not fulfil the specific needs of the York community. For the Shire of York to have a Human Resources Manager looking after its staff, when it cannot adequately communicate with, and does not have the respect of its ratepayers is a sick joke. York cannot afford such a macabre sense of humour.

Any new senior staff members employed by Council must have the tertiary qualification compatible with the advertised position and their resume must reflect at least three years satisfactory employment in a similar role.

With regard to any future involvement of York & Districts Community Matters in possibly disseminating propaganda on behalf of the current administration, this will be tempered by the fact that Mark Lloyd, its’ Editor and Publisher is not a journalist and therefore he should be fully aware of his limitations.

In the past Mr. Lloyd has sought my assistance on several occasions when threatened, in writing, by Ray Hooper. Mr. Lloyd was aware of my thirty-year involvement in the Australian media.
One particular instance was the publication of a cartoon caricature of Mr. Hooper depicting him in a similar vain, and garb, to Adolf Hitler. 

I provided Mr. Lloyd with a rebuttal which Mr. Lloyd published next to Mr. Hooper’s threatening, yet ridiculous diatribe. Mr. Lloyd published this rebuttal under his own name which I had no problem with. (Mr. Hooper’s response was deathly silence.)

In conclusion I am sure Mr. Lloyd is an astute business who understands the meaning and ramifications of his publication to be allowed ‘to be distributed, by post, as a newspaper’.

    Our cartoon-magician has pulled a rabbit (nay, an ape and more) out of a hat again.

    On the matter of The Bobbsey Twins: well, apart from the obvious reference to two key characters, there were 72 books, so there will be much more scope for illustrations to go with our chief journos' and bloggers' future revelations. So not to worry. The 'They' cannot shut us down yet; there is so much more work to do — at least 72 more essays' worth.

    The second cartoon? Well, the ape bears a certain resemblance to the man we are not allowed (by the Best Man) to name; the far right character is obvious — although he apparently needs a placard to explain himself and his mates, being supposedly otherwise unable to articulate his messages clearly. (I believe I did read somewhere that sign-language would be appropriate in his case.) Bit hard on the 'Elvis' and the 'Alien' to be stuck in such company, though — or do these two represent the two sides of the 'in-between' CEO? Oh well; as with parables, maybe with cartoons — not meant to be analysed too deeply.

    So, before I go to sleep, perchance to dream of a better, fairer future: From a left-brainer to a right-brainer: Thanks for the pics.

      Wonder if it has anything to do with Nola touting to locals Mr. Best IS the best!

    2. It gets worse, I have just read further on in the Blog Mr. Best invited select people, including Mark Duperouzel to breakfast at this same Hotel. Remember he let down York by voting for the Rubbish Dump at the JDAP meeting.

      Nice display of discrimination Mr. Best. Many residents put their heart and soul into your various groups, how come they were not included?

      Were any of the innocent 'trouble makers invited?

    I believe the Shire of York writes the information for the page they use, not Mark Lloyd.

    1. It's my understanding that the Shire is employing a journalist to write the copy for its Voice of York page. I think the journalist may be Troy Granville, author of those very funny April Fool's Day jokes. The quality of the paper's prose has improved by several orders of magnitude since he began writing for it - another of the 'wonderful things' happening in York.

      I hope we can keep that statue, by the way. Perhaps the Shire would like to distribute collection boxes to every York business, along with a small poster displaying a photo of the statue and appealing for donations. We could also have a metal donation box secured somehow to or near the statue, to be emptied by Shire staff every day.

  4. I think its got more to do with Best's attempted to manipulate of the local rag. Best wanted Lloyd to publish twice monthly so he could counteract statements made in the blog. Best's intention was to flood the town with tales of joy in some perverse attempt to disguise a demoralized town. His visioning is not working, seems the populace has perfect 'vision' and can see straight through JB's visioning!

  6. I agree with Anonymous 5 May 2015 at 17:48. Mr B is certainly not seeing a revitalised town. Numbers at the Advisory Groups are low, and we have yet to see the Ex-Ray Visionary Forums occur; or maybe they should be called the Invisible Vision-ing Forums. There are not too many weeks left before we get our own identity back, and in that time we have SITA matters to deal with on top of all the other schemes and unresolved issues. This is certainly a heavy time. Not that Mr B had any idea what he was coming to, poor man. He must be wondering what he did to deserve the misinformation he was sent here with. He will go away with his salary and more on his CV, but not the fulfillment of his dreams of working miracles.

    1. Reading the Minutes just out, seems Mr. Best has decided to implement Ray Hooper's old tactics - cause disharmony within the community by blaming certain residents for the Administrations inadequacies.

      Residents would have no need to lodge FOI application if York had had an open and accountable Council and Administration under Ray Hooper. It is below the belt Mr. Best to blame residents for the high number of FOI applications, after all you told us when you first arrived you saw no need for FOI's. Seems now you have experienced the dysfunctional and not so open and accountable Shire of York Administration you seem to have changed your mind.

      On the subject of the YRCC. Mr. Best's response in the Minutes as to why the Shire has not provided the costing on the YRCC: It is more comprehensive than you think.

      As the Project Manager Ms. Maziuk should have kept a comprehensive running cost sheet on the project -that is of course IF she had done the job properly! Still no final figures? unbelievable.

      Anyone checked the safety issues at the Wreck centre? Here's just a few. Dirt (or mud if it rains) to walk through from the car to get inside, cheap plastic drain covers are not fitted securely (they are lifting) causing a tripping hazard, loose sand on brick paving, another safety slipping hazard. A rusty grid in the walk way is bent up on one corner, another tripping hazard.
      The carpet in the so called 'Conference area" is absolutely filthy with food stains from one end to the other.
      The YRCC is a disgrace - clean up the Shire's in house mess Mr. Best and stop using smoke and mirrors with FOI costings and Legal fees for the Fitz Gerald Report to divide our community!

    2. Yes, CB: I have observed the same hazards very recently. They will have been there for a while, but we have just ignored them. The fact that there is so much sand to walk on, too, in places such as between the Pavilion building and a fence near the bowling green. Very inconvenient and messy. We are not living at a beach, but in a town and should be able to wear our shoes through there without getting sand in; similarly not slip, catch a foot and get an infection if the rusty grid breaks through etc... And just imagine the risk of slipping in mud when the rains come. And how dare we hope to have people come from elsewhere and hold conferences in York with the carpet in the Wreck Centre being so filthy. This is not the way to attract people to return to York if they experience these things on a visit.

    3. Do the Shire of York conduct regular Safety Audits on the YRCC centre? Can these be made available to the Public?

      The complex is a litigation nightmare waiting to happen. Who is the person responsible to carry out the audits and are they qualified?

      The carpet is disgusting. I doubt it meets health standards given it is a food outlet.
      How can the Shire consider promoting the venue as a Conference centre with the carpet being so putrid - it is embarrassing.

      Who gave the Administration permission to run up such a large Legal bill for the Fitz Gerald Report? Who advised Staff not to release documents requested by residents?

      So yes Mr. Best, clean up your own in house mess and stop deflecting the Administration's short comings back to the community.

Seems our cartoonist has solved the identity riddle by posting his/her latest ("3 Stooges" etc.) cartoon — 3 Stooges plus one D/Stooge with the Elvis hair; that is, unless he/she is playing games and changing the interpretive rules, which I'm sure he/she would not tantalise us by doing :-)

  8. Local governments, especially those in rural WA, have an established political culture with certain expectations and practices that often determine what is seen as acceptable and not acceptable in local politics.

    In rural towns with an underdeveloped political culture, accountability is low and ethical standards are at best, rare, at worst, non-existent. This encourages corruption to take hold because the public wouldn't know what corruption was if you smacked them around the face with it, and local identities are not afraid to be corrupt because of low accountability.

    In some rural towns such as York, councils have been corrupt for so long that the public think that is how it is supposed to work because that's how it's always worked.

    Any prolonged period of instability in a council is bound to lead to corruption because people are unsure of how the council should operate, consequently, they don't know what practices are corrupt or what to do if they are corrupt.

    So, when a commissioners takes it upon himself to municipally fund private enterprise, you can be certain that by definition, its corruption! Its bad enough the commissioner agreeing to municipally fund space in a local newspaper to advertise a favoured business, now it's become clear that the commissioner intends to spend between 10 -20K on a publicist to write a glossy piece on Faversham House to be published in some glitzy wedding rag.

    It's a typical bureaucratic solution when faced with a problem, throw lots of public money at it in the vain hope it might fix it. For some obscure reason , the commissioner believes that Faversham House and the York Palace Hotel will save the town, almost as though the very existence of York depends on it.

    Hopefully, I have my facts wrong, and someone in the know can disprove this latest horror story.

    2. The Commissioner did go on the record and state he (the Shire) was going to hire a journalist to counteract any negative publicity. I suppose a lot depends on what James Best classes as negative publicity, seems he cannot stand any sort of criticism, so, in retaliation he's going to use public funds and piss in the pocket of anyone who's nice to him.

      Who knows, the way things have gone (backwards) lately, he may even name the residents responsible.

    4. J.E.P. it is becoming clearer by the day Mr. Best intends to leave York with a few runs on the board to add to his CV, no matter the cost to our community.
      Do you know if the 10-20K being spent for the publicist is Ratepayers money? If it is it could be considered misappropriation of public monies!

  9. On the topic of job qualifications: not long ago I asked a question on notice about the qualifications of senior staff. The answer I got was not illuminating. It included the suggestion that York is unable to attract qualified staff and left open the possibility that existing staff had no qualifications at all.

    I also asked if any members of staff were currently enrolled or intended to enrol in education or training courses relevant to their positions. That question, as I recall, was not answered.

    I don't want to pick on anyone in particular, but it does concern me that if the answer I was given was correct, the second most senior officer in the organisation, the DCEO, has no relevant qualifications and is doing nothing about acquiring some. The same would be true of the planning and finance officers. I find that disconcerting, to put it mildly.

    Equally disconcerting is the suggestion some have made that important positions, including that of DCEO, were filled without advertisement. Is that true?

    1. I wonder if we can see Ray Hoopers original application for the position of CEO in York. It would be interesting to see what he claimed he had done, or would it be classified top secret, a threat to national security or man kind?

  10. James, Staff qualifications has been a touchy subject at the Shire of York for years.

    TC was appointed Acting DCEO by RH and held the position for some time prior to the position being advertised. Several applications were received for the position and TC was concerned she would miss out. It was leaked from the Administration that TC voiced her concern to RH in front of a few councillors during one of the council briefing sessions and she was told don't worry the job's yours. This was before any interviews had even taken place.
    The applicants would be the only ones who could confirm if any of them were in fact interviewed or whether they simply received the standard 'your application was unsuccessful letter'.
    Ray Hooper would have made the final decision and under his rules it is possible no one was interviewed.

    Ray Hooper always became anxious and twitchy when questioned about the Staff's qualifications.

    If Staff have tertiary or relevant qualifications you would expect they would be proud of them and happy to display them. This issue could be easily resolved if Staff names and their credentials/qualifications were on a board in the front of the office. It would confirm we are getting what we are paying for.

    1. I suppose this raises another question: did Ray Hooper have qualifications pertinent to his job? Does Graeme Simpson? I believe Mr Keeble had an accountancy qualification, but I'm not sure.

      If Kira Strange is qualified in her field - I have no reason to doubt it - why wasn't that fact included in the Commissioner's answer to my question?

      Finally - if staff are unqualified, what's to stop them studying to acquire them? I completed a master's degree and a diploma in modern languages while working as a lecturer and campus manager. If they're smart enough to do their jobs, presumably they're smart enough to do the necessary study.

  11. I believe the current planning officer, Kira Strange, does have a degree in her field. This is verifiable with a tiny bit of basic research. This does not mean, however, that every person who has had that role did, though. One such person several years ago did not, I believe.
