To Mr. James Best,

Rejoice you extreme Jihadists of the Caliphate of Kroy. I have received a three-paragraph, signed he-mail from the Commissioner himself. What an honour. I felt I was about to swoon but I just made it to the smelling salts in time. ( For those interested Kroy is York spelled backwards, the direction it is still heading despite any best endeavours)

What an ebullient, albeit short, explanatory epistle it is Mr. Best. It makes Jenni Law’s efforts read like those of the literary genius like Leonid Tolstoy. Yes! it is Leonid, but as you have been told before-W.B Yates is W.B Yeats. But hey, what’s in a missing “e”other than lack of knowledge.

Wow! there is a change of direction warranted. We’ve known that for two years. Or does this mean that the YRCC premises will peer vacantly to the South West, rather than North-East as it does now?

And who was the brilliant mind that finally realized changes were needed. Was it the best from Best Business Communications Pty Ltd,  (BBC)? With such a grandiose personal company name -you must be listed on the ASX.

Now it is your intention to review the gaps within the report. I am assuming here you mean the above mentioned Guy Lehmann Report. By “my intention” I assume you mean that you are qualified as a business marketing analyst listed on the UWA register has having an in-depth knowledge of the tourism, restaurant, liquor, convention and hospitality industries?

No you are not. You have a Curtin University Arts degree majoring in sociology and politics. That’s the next level above Honours in Window Cleaning.

Your expertise is allegedly as a consultant in the nebulous world of strategic facilitation, ideation and visioning. A socio-political clairvoyant, with a touch of oxymoron. 

Your inference is that there were gaps in the Lehmann report. Are you suggesting the report is sub-standard? Have you authorized the payment of $10,000 for a report with gaps? Or have you had a “Light-bulb Moment” which will bring gasps of amazement from an extremist minority and attempts at squeals of joy from the vast, mute majority?

The liquor licence you are referring to is a Commercial Tavern Licence. Anyone with half a brain realized that the Shire of York Council Administration did not have the qualifications or any form of ability to be a publican and meet the terms and conditions required in the Liquor Licencing Act. The YRCC has not met these standard obligations since the day the doors first fell open. (Sorry I think that was the toilet doors after the brand new sewerage system exploded).

Your proposed finalization of the Competitive Neutrality Plan is a tad late. There is little to no competition to be neutral about. It may be best to refer to it as your Competitive Neutered Plan. 

It often worries me how the flotsam and jetsam of the Local Government Chief-Executive-Officer whirlpool keeps bubbling to the surface to have a feeding frenzy on the fat carcass of the lucrative, rort-riddled third tier of democratic governance. 

Dominic Carbone for instance was told see-yu-later by the City of Canning, the worst performing council in the 21st Century . Yet like the radio series ‘Chickenman’-“he’s everywhere”.
Especially when there is a fistful of dollars to be made by hanging around a few Shire Council officers and offices. This appears to include you.

Now regarding your impressive business nomenclature. It is more than likely a ‘shelf company’ that you can register 24/7 on eCompanies.com.au for just $507 while you are eating your Cornflakes. It has no business website, no email address, no telephone or mobile number, no facsimile, absolutely nothing- under the business name of BEST BUSINESS COMMUNICATIONS PTY LTD (BBC) and your registered office may well be an Australia Post box in Leederville, WA 6007. This is the ersatz business registration that receives the massive monthly salary cheques you have no problem in accepting.

On November 17, 2014 you changed your company details and changed your Registered Address, just prior to being hired as Commissioner. What for I am sure nobody will ever know, accept, hopefully, the ATO.

Obviously, after scouring the newspapers for new business opportunities, you saw the “Show Cause Notice” served on York Council and smelled that sweet smell of lots of ratepayers cash.
You came up to York on two occasions to skulk around the Council meetings of December 8 and 11, 2014, to see how much of a jackpot it was going to be. Then off you trotted to Tony Simpsons office to make sure the Show Cause Notice was enforced and you became the extremely cashed-up saviour of York.

Firstly as a socio-politician you do not have to be Freud or Churchill to understand that your “reds under the beds”, extremist, Australia Day speech meant you were useless and worthless to the people of York from the time you finally shut your mouth. I would not doubt that this is biggest faux pas you have made in your career and it will follow you around where-ever you go.

Finally- Do not ever send me an email like this one again! . All I will do to this kind of crap is pull it to pieces and hang it up for the ridicule it deserves.

    1. What is the change of direction he refers to?

    2. Why is it warranted?

    3. What gaps has he found in the report that require investigation?

    4. What seems to be wrong with the current liquor licensing structure?

    5. How does he intend to finalise the Competitive Neutrality Plan?

    In fairness to Mr Best, let me say that at least he has a tertiary qualification, unlike (so far as I can discover) his colleague Dominic Carbone, and Curtin is a reputable university. Some of my best friends went there.

James, I think the concern here is that no one knows exactly what the Wreck center has cost to build, cost to repair, cost to maintain, cost to staff, cost to operate, cost to stock etc etc. Sadly, the public have no idea, there are rumours the center has cost anywhere between 7 -12 million, even past and present Councillors have no idea. Its simply not good enough. Ex Councillor Walters was given access to 1 document after requesting records under FOI, it turns out after the Commissioners external review there are 2000 documents which fell within the scope of her request.
    Why is this information so secret? Why has it never been in the public domain? Why was Guy Lehmann refused access to records in order for him to prepare his report? The biggest why is why is the Shire involving Carbone? The only possible reason is to hide the truth, the same as he attempted to do over the visitor center fiasco. So wrong, so corrupt!

  4. I didn't know that Mr Lehmann had been refused access to records, but of course I should have known or at any rate guessed. What is happening to Ms Walters' FOI application since the FOI Commissioner handed down his decision in (as I recall) December of last year?

    Local government in WA at every level seems bedevilled by a culture of secrecy, deceit and intimidation. Why? The only explanation I can think of is that it is also bedevilled by chronic corruption and perhaps chronic incompetence as well.

    1. Mr Best said the report was never actually undertaken. Therefore I am at a loss to understand what report he found gaps in. As for the reason the report was not undertaken only Guy knows the truth and we should encourage him to tell it without fear.

    Come on, these are simple questions which the community deserve truthful answers .. a foreign concept at York. Over to you, communicate.

    Well, if Guy Lehmann was refused access to certain relevant documents as suggested by Anonymous 6 March 2015 at 17:56, no wonder there were 'gaps'! As to Carbone, that shocked us all in the meeting of 16th Feb., yet apparently no-one is backtracking or realising they have been misled (not even the VERY BEST person there is in York).

    And James P (so much further down in the alphabet), when I read your words "chronic corruption" I almost read it as "chronic constipation" which reminds me of "the devil's in and can't get out" of Faust. (Now you can question my sanity, if you wish.)

    But why do we have to cope with obscure phrases like "Competitive Neutrality Plan"? Not much better than "strategic facilitation, ideation and visioning". I suppose they can hardly use long phraseology like "plan to eliminate any pricing advantage government owned entities enjoy which has arisen out of their public sector ownership". I do hope, David, that you were familiar with the terminology when you received Mr Best's letter. I had to google it (http://www.dob.nt.gov.au/business/tenders-contracts/legislative_framework/tendering-contract/Pages/competitive-neutrality.aspx), myself.

    Then there is the term "Competitively Neutral Tender Price" (from the Dept. of Business website quoted above". Doesn't that remind you of the Commonwealth's quibbling about the use of plain English or jargon phrases in the debate about production of submarines?

    Which takes me back to your topic "Notes From The Underground", James P; under the ground, under the sea — oh dear, this IS all turning me mad!

    1. Thanks for picking up on the pretentious bureaucratic language, Mr Micallef (if so I may call you). It's intended to make us feel excluded and inferior. It also obfuscates underlying issues that might prove embarrassing if more clearly expressed.

      The compensating factor is that when you hear it, you know intuitively that somebody is engaged in pulling the wool over your eyes. Never pretend to understand it when you don't; ask the one who's using it 'Would you mind explaining precisely, in plain everyday language, exactly what that means?' It will then become obvious to everyone in earshot that 'the emperor has no clothes'.

      Try to stay sane. Somebody has to.

  7. How come Mr. Best knew to come to York for Council meetings December 8 & 11, 2014?
    Had Mr. Best already been chosen as the Commissioner BEFORE the response to the Show Cause Notice was read by the Minister and DLG? (if it was read )
    Did Mr. Best show Mr. Reid courtesy and advise the then Shire President he was present at the meeting?
    I do not recall Mr. Best announcing his presence .
    Did Pat Hooper by any chance know Mr. Best was hovering like an eagle ready to pounce?

      Thinking outside the box - seems the plan to 'force' York into Commissioner mode was hatched back in 2013 by Ray hooper.
      That plan failed because Ray made a blunder - he believed if two councillors resigned, 4 councillors would fail to meet the quorum required by the LG Act. That 'wrong call' shows how inept he was.
      It would have taken a few liquid refreshments, but eventually he and his mates at the DLG came up with another plan - the L.G. Probity Audit.

      The 'brains'?? in the DLG did not, in their wildest dreams, reckon on the Blog Master creating the 'People Power Probity Audit' ( PPPA).

  8. No coincidence. Best would have been selected and lined up in advance, which proves the show notice process was a fraud.

    Very simple Mr Best, come clean about exactly when you first approached about the commissioner role, who by and how?

    Did you attend the council meetings 8 and 11 December 2014?

    If so, why? Have you been paid to attend, and if so how much and who by?

    Come on Mr Best, honesty, open and accountable, communication, probity and all those weasel words that mean nothing to you mob.

    Your failure to answer can only be taken that you were lined up to be the commissioner in advance of the show cause notice. That exposes the Minister and the DLG.

    All starting to unravel.

    As I said somewhere else: a person very well known to me, who is totally familiar with how the 'public' ??? service ??? works, when he heard that only lately had the DLG/Minister asked the remaining councillors what training they have had (despite having had it spelt out —Matthew's at least — in 'our' response to the Show Cause Notice, despite being normally totally inscrutable re public service matters, broke into a subtle smile and said of the DLG/Minister "they gave themselves away, then, didn't they". Forgone conclusion, the lot of it.
