A blissful bailout

He who, in his own best interest, should consider it ‘Best ‘ to remain nameless will soon be setting sail westward. Maybe this will be back to become a permanent, pre-next election fixture at the bottom of Tony Simpson’s  local government rose garden as a living memorial to the Shire of York Council’s folly in daring to question a Minister of the Crown- while still in office .

Or maybe not- he may have some ‘Town of East Fremantle 2029 Needs Analysis’ to vision for a fat- fee.

Then again according to Roel Loopers, the author of the online publication Freo’s View, he could have some allegedly poorly finished business with the City of Fremantle to re-attend to- or try to ignore.

Mr. Loopers claims, and I quote from Freo’s View, Mr. Best’s recent $80,000 visioning report for the port city was not worth the paper it was printed on. Mr. Loopers alleges it is a lazy, plain, uninspiring summary of poorly attended workshops- and queries whether anyone researched if the consultant (Mr. Best) has the academic knowledge to analyse community issues? (That is Mr. Loopers publically stated opinion which he should be perfectly entitled to.)

In York’s case this opinion is immaterial, as long as the Minister for Local Government and Communities, Tony Simpson, thinks Mr. Best is the best- that is all that matters.( And the so –called Shire of York’s  ‘Official Unofficial’ online publication should not have any adverse opinion that it is perfectly entitled to.) 

What is the difference you ask? The Shire of York was audacious enough to question the lack of credibility of a Government Minister and his staff, Mr. Loopers only questioned the credibility of someone who had, at that stage, just been employed as Shire of York commissioner by Minister Simpson.

So what has Mr. Best done for York that Mr. Loopers considers could have been done by an Administrative Assistant acting on behalf of the City of Fremantle. Only those who, possibly, in their own self- interest, have attended Mr. Best’s visionary workshop séances would know.

How many in York attended these workshops is debatable. Mr. Loopers claims the number of people attending Mr. Best’s Fremantle workshops may have been grossly exaggerated. The numerical methodology apparently being used is - if the same 10 people attend 10 workshops then 100 people rocked up to be visionary inspired.

So what are Mr. Best’s recent activities, initiatives and key strategic activities for and on behalf of the York community?

One is to purchase a gutted property, being Lot 800, 801 South Street York for $625,000 from Nola and Dick Bliss, part of which will be used as a carpark. This property has allegedly been on the market for two years and has been purchased by Mr. Best for, arguably, well above market value.
(In the 1980’s, Alan Bond, purchased Channel 9 from Kerry Packer for over twice its market value. This was the penultimate financial blunder that sent his business empire crashing down around his ears.)

If you look at Mr. Best’s budgetary measures adopted by himself at a Council Meeting on June 26, 2015, for the 2015-16- Financial Year, nearly $500,000 has been removed from local road maintenance while an additional $562,000 has been dug-up for recreation facilities. It means an extra $947,000 in this year’s budget has been set aside for recreation while local farmers bounce along through the potholes.

This basically means that after a farmer hits a huge pothole in a Shire maintained road, he can have a beer to calm his shattered nerves at the YRCC Tavern or The York Palace Hotel. That is if their bars are open and he survived the impact and allowed to drink on his medication.

So are the people in York who know Mr. Best- best- those who are accused of employing Visa-less workers and have no shire planning approval for some of the structures on their properties, or are they the normal, genuine, hard- working country folk who have their towns best interest at heart?

Only Mr. Best can answer that question and, at the end, he may well have to.

So what is the definition of Commissioner, made up of commission and “er”? Commission is in this case is a large payment for services rendered. “Er” probably means who actually knows what services were rendered!

Dear Sirs,

Decision to approve Shire of York Budget 2015-2016

At a Special meeting of Council held on Thursday 25 June 2015, Commissioner James Best autonomously approved the Shire of York Budget 2015/16. Within the budget was a provision of $625,000 to purchase lots 800 and 801 South Street, York. It is understood that there is a commitment to purchase.

I do not believe the decision to approve the Budget was a lawful one.

On 6 January 2015, Council was suspended and on 7 January 2015, Commissioner James Best took up office. The first FRAC meeting for 2015 was due to be held on 9 February 2015 however due to the suspension of Council this did not occur.  There have been  no further Finance, Risk &/or Audit Committee meetings during the first six months of 2015, yet Audit committee meetings are to be held at least quarterly.

An independent and effective audit committee is critical to good governance. It assists council in discharging its responsibilities, and strengthens the financial accountability of the council and its senior management.

Key responsibilities of the audit committee include overseeing an entity's risk management framework, internal control environment and the accountability of senior management, engaging with internal and external audit and monitoring the status of actions to address audit recommendations.

The Local Government Act 1995 (the Act) requires that all local governments establish an Audit
Committee. The primary responsibility for establishing and appropriately using an audit committee rests with the appointed council.

LOCAL GOVERNMENT ACT 1995 - SECT 7.1A
7.1A .    Audit committee
(1) A local government is to establish an audit committee of 3 or more persons to exercise the powers and discharge the duties conferred on it.
(2)  The members of the audit committee of a local government are to be appointed* by the local government and at least 3 of the members, and the majority of the members, are to be council members.
* Absolute majority required.
(3) A CEO is not to be a member of an audit committee and may not nominate a person to be a member of an audit committee or have a person to represent him or her as a member of an audit committee.
(4) An employee is not to be a member of an audit committee.

Membership
The Act requires that an audit committee is to consist of a minimum of 3 members and in that situation all must be council members. Where a committee consists of more than 3 members then a majority of those members must be council members. Local governments may decide to appoint a committee involving only elected members or they may appoint one or more persons who are external to the Council. If a Council considers it appropriate, the whole Council can be appointed to the audit committee.
If the local government wishes to appoint one or more persons other than elected members to the committee, which is recommended, it should ensure that they have the requisite knowledge and skills to provide benefit to the committee.

Operation of the Committee

Irrespective of the membership of the committee, all legislative requirements relating to committee meetings such as advertising meeting dates, notice of meeting and keeping minutes of meetings need to be complied with.

 I have spoken with DLGC and subsequently to the administration at the City of Canning Council.

I would confirm that the current three Commissioners of Canning Council act as the Audit Committee in place of Council.

I would also confirm that when there was only ONE Commissioner, two external members were appointed to make up an 'Audit Advisory Group' to enable the process of recommendations to Council and in turn legitimise the decision making process.

This has not been the case at the Shire of York.

'Additional Requirements'

New regulations were gazetted for the Local Government (Audit) Regulations 1996 in February 2013. As a result of those amendments Local Government Operational Guideline 9 – Audit in Local Governments was revised.

The new Regulation 17 prescribes a number of matters that are to be reviewed by the audit committee.
These functions include reviewing the Chief Executive Officer's report on the appropriateness and effectiveness of the local government's systems in regard to risk management, internal control and legislative compliance; and reporting the results of the Committee's consideration of that review, to the Council.

This report and review process is to occur at least once every two calendar years, with the first review of each of the three areas to be completed by the CEO, reviewed by the Audit Committee and reported to the Council, by 31 December 2014.

Western Australian local governments are required to complete an annual Compliance Audit Return (CAR) in accordance with the provisions of the Local Government (Audit) Regulations 1996 (Regulations). The CAR must be submitted to the Department of Local Government and Communities (Department) by 31 March 2015.

The period examined by this audit is 1 January to 31 December 2014 and the completed return is required to be:
·         Reviewed by the Audit Committee
·         Considered and adopted by Council
·         Certified by the Mayor and CEO following Council adoption
·         Submitted together with a copy of the Council Minutes to the Department by 31 March 2015.
I do not believe that any of the 'Additional Requirements' have been discussed or documented in the Shire minutes, however, if you can show that they have and I am incorrect, I will graciously apologise.

  2. Best is a two bit conman, this deal stinks of cronyism. Without accusing the Commissioner of any wrong doing, how do we know he's not up for a backhander, if he is we'll never know.
    The towns running on close to a zero surplus and he's borrowing 600K to bail a mate out of financial strife.
    Doesn't make any sense.
    Congratulation to the Bliss's all has suddenly become very clear.

It would be interesting to know what the Shire sold the building for, exactly when, what its valuation was at the time and whether it was sold by Tender or on the open market (which should depend on the rules about Shires selling property, of course. Certainly the Old Convent that the Lawns bought was sold by Tender — in 2008 for $350,000 inc GST). Hard to compare values across the years, and the two buildings' condition at the time of sale, though, unless you are a valuer, not surprisingly.

  6. Local Government bailouts are an unknown phenomenon, probably because they rarely happen, if they ever happen at all. Bailouts and rescues introduce legal implications which are best left to the judiciary to ponder over. However, the morality of such actions to bailout a 'friend in need', needs to be debated on (vigorously). Mr Best's latest bizarre irrational and questionably illegal behaviour, has set the scene and made conditions ripe for more of such ad hoc nonsense to continue. After all, why bother to be competent when incompetence clearly pays. Hands up who's struggling!
    One obvious advantage for letting the free market punish incompetent, reckless, greedy and stupid business operators, is it separates the wheat from the chaff. By bailing out and rescuing the Bliss's, Mr Best has used precious municipal resources (which are scarce in such a time) from advancing the growth and prosperity of the WHOLE of the business community. The net result of this is the economy as a WHOLE will become more and more inefficient.
    The competent businesses (via their rates which, have recently increased by 12% in real terms) are now propping up the Bliss's. I wonder if Mr Best will show other ailing businesses the same consideration?

    1. Yes he has been re-employed because George Johnson cost too much.

      On the basis that Gail Maziuk has been given the role of Acting DCEO because of her extensive financial experience and qualifications in the field, it can only be assumed that the position she leaves behind, Human Resources Manager, would have been taken on by one of the depot workers?

  9. James Best forgets, if you're going to lie you need a bloody good memory, he hasn't! I've heard lots of different stories from various people around York, all have been spun a yarn by Best as to why he's decided to buy Chalkies on our behalf.

    1. Chalkies has just come onto the market.
    2. We had to keep it quiet so no one else buys it.
    3. The Bliss's had lots of offers so we had to get in there quick.
    4. We bought it so Peace Park can't be built on.
    5. We have a grant in place to pay for it.
    6. We need the extra car parking space.
    7. It's difficult to use Avon Park because of the caravans.
    8. If we have events in Peace Park it means the main street doesn't need closing off.
    9. The Bliss's are prepared to lease it back
    10.The Bliss's were prepared to drop the price from 650K to 625K because the Shire were buying it.
    11. The Old School can be used as a visitor centre.
    12. Peace Park can be enlarged by grassing the Old School car park.
    13. There were loads of offer in so the Shire got a bagain because they could move fast.

    All these fairy tales in less than 24 hours. The Shire should be holding a crisis meeting to get their stories straight at least.

      I heard the story of number 11 several times recently from very different and good sources.
      I was told that Mrs Bliss (who has a vested interest in tourism) was in negotiation the Commissioner (Best) and was pushing to have the Visitor Centre located at the Old Convent School - seems it worked!

      A very naughty conflict of interest there for Mrs Bliss and a nice business boost in all directions for them.

      Other businesses should make a stand and ask for a hand out.

Its astonishing that the same Council used our resources to close one particular business(s) down because it had an immense dislike for the operator(s), yet it will use the same resources to bail out a business who's operator it likes. Doesn't make any sense, I question how any of these actions are in the best interest of the community.

    4. Nothing astonishes me about the the Shire of York any more.
      We all thought the Fitz Gerald Report was the worst it could get, but this deal to purchase back a building the Shire off loaded previously because of the high cost of maintenance has left most speechless.

      I realise it is no solace to the operators of the business the Shire relentlessly targeted and succeeded in closing, but they can hold their heads high because they are honest people and the majority of York now know they did nothing wrong. They deserve and should be paid compensation by the Shire of York.

      I wouldn't go to the York Palace if was the last place in York open.

  10. I put this information on the other blogspot but want to be sure everyone sees it so am submitting it here, as well.

    This afternoon, Richard Bliss confirmed Chalkies has been for sale for a couple of years. Re A. Business’s list of reasons - supposedly put forward by Mr Best at different times as to why he had to act without community consultation, then disregarding strong opposition to the proposal once it became public at the Special Meeting Thursday evening (which very few residents knew about) - where are all these other phantom buyers? Were they hiding in the wings for the past couple of years, just waiting for the Shire to offer more than anyone else has been prepared to offer?

    Mr Bliss told me we should ask him and Mrs Bliss upfront for clarity about matters rather than make up 'stories' (eg, the Economic Development breakfast they hosted). So I decided to take him up on this offer and asked what he paid for the property, when they purchased it, had it been officially valued for the Shire and (when he responded ‘yes’), how long ago. There was an initial refusal to answer my first question (Richard asked me when I last had a shower!), but eventually some figures were forthcoming. All I’ll say here is that the Blisses are receiving more than they paid approximately 3-4 years ago. Considering the value of real estate over this time period, is it reasonable to accept that values for property in York have increased?!? Somehow, I don’t think so, unless there have been some very significant improvements on the property to increase its value….

    Oh, by the way, the valuation was done by a Bank - described as a very conservative valuation as Mr Bliss said we know banks do. Well, not from my understanding of banks when they're looking to do business / offer mortgages or loans. They actually inflate the values so you can borrow more money against their valuations of properties you already own.

    I’m so glad Mr Bliss came into the gift shop today, even though he wasn’t in the most pleasant frames of mind….

    If you haven’t already signed the petition for a Special Meeting to be called in the near future so we can bring this matter to the attention of all the residents. I urge everyone to go to Pert’s Pantry between 9 and 4 or to Settlers’ Gift Shop between 10 and 5 to add your name to the growing lists.

      As for the shower bit, well, he's proved to us all what a grubby little man he really is.

    2. IF the Commissioner was acting in the best interests of ratepayers he should have employed and independent Registered Sworn Assessor.
      No one in York will ever believe there were other buyers waiting to pounce to buy the building - we are not really that stupid Mr. Best.
      No, the Administration thought they could sneak the deal through by hiding the item within the financials instead of being open and accountable by listing it as an Agenda Item - wrong move Mr. Best!

  11. My take on Mr Bliss's unpleasant mood is that the sale hasn't been finalized, meaning there is still some hope for the town and it's financial future that it can be stopped. Otherwise, I believe, he would have been crowing and very pleased with himself. What do you think?

    At the Ordinary Council meeting last Monday, I recall the Commissioner stating that "there has to be trust between the Council and community". If this is Best's idea of trust, then he needs to crawl back under the stone where he came from and seriously think about learning how to engage his brain before he opens his big mouth.

  16. If Simpson or Gail are responsible for compiling the info from the survey, they will work hard to make it look the way they want it to look. They sure as hell won't declare the people are not happy with them.
